PREAMBLE


The purpose of the website www.seashellswimwear.com is to present, promote and sell the creations of the SEASHELL brand.
Any order placed on the site implies the Client's unreserved acceptance of these Terms and Conditions.

SEASHELL reserves the right to modify these terms and conditions at any time, the applicable version being the one in effect at the time of the order.

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between the company SEASHELL SWIMWEAR, a limited liability company (SARL) with a capital of €3000, registered with the Trade and Companies Register under number [SIREN], whose registered office is located at [full address], and any natural or legal person wishing to make a purchase via the website [www.seashellswimwear.com], hereinafter referred to as "the Customer".

ARTICLE 1 - PURPOSE

These General Terms and Conditions of Sale (GTC) define the rights and obligations of the company SEASHELL and any customer in the context of the online sale of swimwear and accessories via the website [website name].

Any order placed on the site implies full and complete acceptance of these Terms and Conditions.

ARTICLE 2 - PRODUCTS

The products offered for sale are those described on the Site on the day of consultation by the Customer.
SEASHELL strives to present and describe items with the greatest accuracy (photos, descriptions, sizes, colors, composition, care instructions).

The photographs are for illustrative purposes only. Minor variations may occur depending on the screen or brightness, without this implying any liability on the part of SEASHELL.

The characteristics of the items sold on the Site (photographs, graphics and descriptions of the items, etc.) are given for information purposes only and may vary over time. They are not contractual.

ARTICLE 3 - ORDER

The Customer selects the products they wish to order on the Site.
The order will only be considered final after:

  • shopping cart validation

  • acceptance of these Terms and Conditions,

  • and full payment of the price.

SEASHELL reserves the right to refuse or cancel any order in the event of a dispute with the Customer, a payment incident or suspicion of fraud.

SEASHELL cannot be held responsible in any way for any input error or transmission error that prevents the delivery of the confirmation email and/or the items.

The Customer is advised to print the order confirmation email.

For any questions relating to the tracking of an Order, the Customer must contact customer service by email by filling out the contact form located on the "contact" page of the site, making sure to explicitly specify the number of their order.

ARTICLE 4 - PRICE

The prices shown on the Site are expressed in euros (€), inclusive of all taxes (TTC), excluding delivery charges.
Delivery charges are specified in the order summary and may vary depending on the destination.

SEASHELL reserves the right to change its prices at any time, but products are billed at the rate in effect at the time the order is validated.

For all products shipped outside the European Union and/or internationally, the price is automatically calculated excluding taxes on the invoice. Customs duties, other local taxes, import duties, or state taxes may be applicable in certain cases.

ARTICLE 5 - ONLINE PAYMENT

Payment is made online via the secure methods offered on the Site (credit card, PayPal, etc.).
The amount is debited at the time the order is validated.

Transactions are secured via the [Shopify Payments / Stripe / PayPal platform depending on your choice].
SEASHELL never has access to the Client's bank details.

The price charged to the Customer is the price indicated in the Order confirmation sent to the Customer by email.

The order is payable immediately, by credit card (CB, Visa, MasterCard, American Express).

The Customer is informed by email, once the Order has been shipped, that their invoice including delivery charges is accessible online in their customer account.

By providing their bank details during the sale, the Customer authorizes the Seller to debit their card for the amount corresponding to the stated price. The Customer confirms that they are the legal cardholder and are legally entitled to use it. In the event of an error or if the card cannot be debited, the sale is automatically cancelled and the order voided.

ARTICLE 6 - DELIVERY

The products are shipped from France to the destination indicated by the Customer when placing the order.
Delivery times are generally 3 to 7 working days after dispatch (excluding pre-orders).

Fees and delivery times may vary depending on the destination country.
SEASHELL cannot be held responsible for delays attributable to carriers or customs.

Products are delivered to the delivery address provided during the order process, within the stated timeframe. This timeframe does not include order preparation time. When a customer orders multiple products simultaneously, these may have different delivery times and be shipped using different methods. The seller provides a telephone contact number (local call rates apply from a landline) in the order confirmation email to facilitate order tracking.

The Customer will receive an order number by email confirming that their order has been successfully processed. The Customer will be kept informed of the various stages of their order by email.

The ordered items will be delivered within a maximum of 30 days from the date the order is registered, provided that full payment has been received. After this period, you have an additional 15 days to contact us to find a solution.

If the delivery address provided by the Customer is not valid and therefore results in the package being returned for non-receipt at the address provided, the costs of reshipping the package to the new address provided will be borne by the Customer.

The Customer assumes full and exclusive responsibility for the risks relating to the Items from the moment of their delivery.

ARTICLE 7 - RECEIPT AND RETURNS

Upon receipt, the Customer is asked to check the condition of the package.
In case of an anomaly (damaged package, missing or defective item), he must inform customer service within 48 hours at the address: [customer service email address].

Returns are accepted within 14 days of receipt, provided that the items are unworn, unwashed, undamaged, and in their original packaging (with intact label and hygiene protection).

Return shipping costs are the responsibility of the Customer, except in the case of an error attributable to SEASHELL.
The refund will be processed within 14 days of receiving and verifying the returned product.

Items must be returned in their new condition:

  • With label

  • With hygienic protection

  • They must be free of stains, odors, or hair.

Returns and exchanges are not possible on sale items.

Any non-compliant return will be rejected and SEASHELL will be released from all liability.

No prepaid return label will be sent by SEASHELL

Return shipping costs will be reimbursed by SEASHELL only in cases where the delivered item is different from the one ordered.

After a period of two months from the date of the transaction, and in the absence of a written claim relating to a refund, the company SEASHELL reserves the right to consider the transaction as definitively accepted by the customer and disclaims all liability in this respect.

ARTICLE 8 - RIGHT OF WITHDRAWAL

In accordance with Article L221-18 of the Consumer Code, the Customer has a period of 14 days to exercise their right of withdrawal without justification.
However, for hygiene reasons, swimsuits that have been tried on or whose hygienic protection has been removed cannot be returned or exchanged.

If the Customer wishes to exercise their right of withdrawal, they must submit a return request on the Site using the following form:

All returns must be shipped to the following address. IMPORTANT: Without a specific request via the form, packages will not be processed.

These items must be returned properly protected, in their original packaging (carefully opened packaging will not be considered damaged) and in perfect condition for resale (undamaged, unused, and unsoiled by the customer). SEASHELL therefore advises customers to try on the products in their order while wearing underwear underneath.

Once the return has been validated, SEASHELL undertakes to reimburse the Customer for all sums paid, excluding shipping costs, for their Order, as soon as possible and, at the latest within thirty days following the date on which this right was exercised, to the Customer's bank account used for the payment of the Items.

Under the right of withdrawal, the costs and risks associated with the return remain the responsibility of the Customer.

ARTICLE 10 - GUARANTEES

The products benefit from:

  • of the legal guarantee of conformity (articles L217-4 to L217-14 of the Consumer Code),

  • and the guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).

SEASHELL is committed to replacing or refunding any item found to be defective after examination.

The Seller reminds the consumer that:

  • has a period of 2 years from the delivery of the goods to take action against the Seller

  • that he may choose between replacement and repair of the property subject to the conditions laid down in the aforementioned provisions.

  • that he is exempt from providing proof of the existence of the non-conformity of the goods during the six months following delivery of the goods.

  • that, except for second-hand goods, this period will be extended to 24 months from March 18, 2016

  • that the consumer can also invoke the warranty against hidden defects in the thing sold within the meaning of article 1641 of the civil code and, in this case, he can choose between the termination of the sale or a reduction in the sale price (provisions of article 1644 of the Civil Code).

ARTICLE 11 - LIABILITY

SEASHELL cannot be held responsible for any indirect damage resulting from the use or purchase of the products.

The company is not responsible for any loss or damage resulting from misuse, lack of maintenance, or improper storage.

SEASHELL is committed to describing the Items sold on the Site with the greatest accuracy and to ensuring that the information published on it is updated under the best possible conditions.

However, SEASHELL cannot guarantee the accuracy, precision or completeness of the information made available to Customers within the Site.

In the event of non-substantial differences between the presentation photos of the Items on the Site, texts and illustrations and the Items ordered, SEASHELL will not be held liable.

The Customer acknowledges and accepts that the prices of the Items may vary between the Website and the stores, and that under no circumstances can this price difference be grounds for a request for a full or partial refund of Items purchased either on the Website or in stores.

SEASHELL shall not be held liable for any failure to perform any of its contractual obligations resulting from a fortuitous event or a case of force majeure as defined by the case law rendered by the French courts.

In particular, BELLES DES PINS will not be held responsible for any failure or delay in the execution of Orders, caused by events beyond its control ("Force Majeure Event").

ARTICLE 12 - PERSONAL DATA

SEASHELL collects and processes personal data for order management, customer follow-up, after-sales service, and for sending commercial information when the customer has consented.

The data collected is strictly confidential and is not transmitted to third parties under any circumstances, except for service providers necessary for order processing (payment, delivery, etc.).

In accordance with the General Data Protection Regulation (GDPR – EU 2016/679), each user has the following rights:

  • Right of access, rectification, objection, deletion and portability of one's data

  • Right to withdraw consent at any time for processing based on it

ARTICLE 13 - APPLICABLE LAW AND DISPUTES

These Terms and Conditions are governed by French law.

In the event of a dispute, the Client will first contact SEASHELL to seek an amicable solution.

In the absence of an agreement, the French courts will have sole jurisdiction.

ARTICLE 14 - IN CASE OF FORCE MAJEURE

The seller's obligations under this agreement shall be suspended in the event of a fortuitous event or force majeure that prevents their performance. The seller shall notify the customer of such an event as soon as possible.
